Creator terms

How creators are paid, how refunds are handled, and how minimum prices work.

These Creator Terms are the agreement between you and Plenishly, Inc. ("Plenishly") when you sell on the Plenishly marketplace. They add to the Terms of Service, the Privacy Policy, the Community Guidelines and the Refund Policy. If they conflict, these Creator Terms win for your creator account.

Section 18 has an arbitration agreement and a class action waiver. You can opt out within 30 days.

1. You are an independent business

You are an independent contractor, not an employee, partner, agent or franchisee of Plenishly. You decide what to make, how to make it and when. You pay your own taxes, insurance, licenses and expenses. You cannot bind Plenishly or speak for it.

  • You set your own prices (above the minimum), hours, methods and workload. We do not train you, supervise you or set a schedule
  • You can sell anywhere else, to anyone, at any time. Nothing here is exclusive
  • You use your own tools and bring your own audience. You can hire help or have others deliver your work
  • You are in business for yourself and may be selling to other platforms and clients too

2. Who can sell, and the rules for what you sell

You must be 18 or older, be approved by us, and give us true and current information. We may decline or end an application or account for any lawful reason.

  • You are responsible for having every license, registration and permission your work needs. In many states, giving individualized nutrition or dietary advice, or using the title dietitian or nutritionist, is regulated. You confirm that what you sell is lawful where you are and where your buyers are
  • Do not diagnose, treat, cure or claim to prevent any disease, and do not give medical advice unless you are licensed to and acting within that license
  • Do not promise results or income. Do not use before-and-after claims you cannot prove
  • Do not make claims about supplements or products you cannot support. Follow the FDA and FTC rules for health claims
  • Do not publish content you do not own or have a license to use. Do not copy another creator's work
  • Follow the Community Guidelines. No political messaging
  • Everything you publish must be accurate, safe and tested to the degree your claims require, including allergen and nutrition information
  • You must keep your products consistent with what you described when you sold them

3. Disclosures when you promote

If you receive money, free products, credits or bonuses for recommending Plenishly or any product, say so clearly where the recommendation appears, in the same medium, in plain words such as "I earn a commission." Do not write or buy fake reviews, post reviews for your own products, offer something in exchange only for positive reviews, buy followers or engagement, or hide a connection to Plenishly. The Federal Trade Commission can fine each violation. If you break these rules we may remove content, reverse bonuses and end your account.

4. How you are paid

You are paid a share of the net revenue from your sales. The share depends on your plan and how much you sell in a calendar month. Net revenue means the sale price after refunds, chargebacks and payment processing fees.

  • Basic: 25%, rising to 50% once monthly sales pass $2,000
  • Pro: 50%, rising to 70% once monthly sales pass $5,000
  • Elite: 65%, rising to 80% once monthly sales pass $10,000
  • Creators who joined before these rates keep their earlier rate unless the rate above is higher. Your dashboard shows the rate that applies to you
  • We lock the split at the time of each sale. A later change in your plan or our rates does not change a sale already made

5. Minimum prices

Each kind of product has a minimum price, because some kinds cost more to deliver. We show you the minimum before you publish and we will not publish below it. A product already published below a new minimum can stay at its price, but you cannot lower it. We may ask you to review a product's price if sales of it leave us unable to cover its delivery cost.

6. Payout timing

Every sale is held before it is released to your Stripe balance. How long depends on your record:

  • New creators: 14 days
  • Steady creators: 7 days, once you have 10 cleared sales, 60 days since your first sale, refunds and disputes at 3% or less, and no dispute in the last 90 days
  • Fast lane: 3 days, if you are on a paid creator plan with 50 cleared sales, 120 days since your first sale, refunds and disputes at 1.5% or less, and no dispute in the last 90 days
  • A dispute, a flagged burst of sales, or a drop in your record moves you back to 14 days, including sales already waiting
  • There is no instant payout
  • After release, Stripe deposits to your bank on its own schedule, usually 2 to 7 business days. A first check by Stripe can take longer
  • Changes to your payout details pause payouts for 48 hours
  • We may hold or delay a payout longer if we reasonably suspect fraud, a policy violation, an unpaid balance you owe us, a legal order, or an open dispute, and we will tell you why where the law lets us.

7. Refunds, chargebacks and what we may take back

A refunded or charged-back sale is removed from your earnings. If you were already paid, we may take the amount from later payouts, or from any bonus or commission, or ask you to repay it. You authorize us to do so through Stripe.

You are responsible for disputes and refunds that come from your product, including the fees a bank charges for a dispute. We may submit evidence for a dispute on your behalf and decide how to handle it. Buyers may be refunded under the Refund Policy, or where a product failed to match what you described.

8. Growth bonuses

Plenishly pays creators bonuses for bringing new members to the app. They are paid by Plenishly, not taken from any other creator's payout, and they are separate from your share of your own sales.

  • What earns a bonus: a new member who joined through your link or code and made a meal plan, a member who becomes a paying member and stays 30 days, a weekly and a monthly sign-up goal, and your first sale
  • Each plan has a monthly ceiling on bonuses and a rate. They are shown in your dashboard, along with what the next plan would have paid
  • Bonuses are held for 14 days. If a member is refunded, leaves, or the account is closed in that time, the bonus is cancelled
  • You are not paid for your own account or household, or for accounts that are not real new members
  • Plenishly sets a monthly budget for bonuses and may pause, change or end them. We will tell you by email at least 14 days before a change that lowers what you can earn. Bonuses already credited are still paid
  • We may hold or cancel bonuses we reasonably believe came from abuse, and we will tell you why

9. Creator referral commissions

If you refer another creator, you earn a share of Plenishly's platform fee on that creator's real sales to real buyers, at the rates and monthly limits shown in your dashboard. Commissions are never paid for a sign-up, a subscription or the act of recruiting. They stop if the referred creator's sales are refunded, disputed or found to be fraudulent, and they are held for 14 days like other earnings. No one has to buy anything to join or to refer. Plenishly does not promise any level of income.

10. Taxes

You are responsible for all taxes on what you earn. Stripe collects tax information and issues the forms the law requires, such as Form 1099-K or 1099-NEC where thresholds are met. Plenishly collects and pays sales tax on marketplace sales where the law makes the platform responsible. You must give accurate tax details and keep them current. We may withhold where the law requires.

11. Stripe

Payouts run through Stripe Connect. You must accept Stripe's Connected Account Agreement and follow its rules, including what Stripe prohibits. Stripe may ask you to verify your identity and business. If Stripe closes or restricts your account, we may not be able to pay you until it is fixed.

12. Your content, and what you let us do with it

You own your content. You give Plenishly a worldwide, non-exclusive, royalty-free license to host, display, promote, translate, format and deliver it to buyers and to market your storefront and products on and off Plenishly, for as long as it is on the marketplace and a reasonable time after for records and buyer access. Buyers who have bought a product keep access to what they bought. You promise you have all rights needed, and that your content does not infringe or break any law.

13. Buyer information

Buyers' information is theirs. Use what you see only to deliver the product they bought, and keep it secure. Do not contact buyers outside Plenishly, sell or share their information, add them to a list, or try to identify them beyond what the product needs. Keep health-related details they share private.

14. Your promises and what you cover

You promise that what you tell us is true, that you follow the law and these terms, and that your products are safe, lawful and match their descriptions. You will cover Plenishly's reasonable losses, including attorney fees, from third-party claims caused by your content, your products, your advice, your breach of these terms or your violation of the law. This does not apply to claims caused by our own fault. We recommend you carry professional liability insurance.

15. Plans, fees and changes

Creator Pro and Creator Elite are paid plans that renew automatically until you cancel, on the same terms as Section 4 of the Terms of Service. Refunds on creator plans follow the Refund Policy. We tell you by email at least 30 days before a change to these terms takes effect. A change will not reduce your earnings on a sale already made.

16. Ending things

You can close your storefront or account at any time. We can suspend or end your account for breaking these terms, fraud, harm to buyers, a high rate of refunds or disputes, a legal requirement, or if you are inactive for a long time. After an account ends, we pay out earned amounts that have cleared their hold and are not subject to a refund, dispute, hold or debt, within a reasonable time. Buyers keep access to what they bought. Founder Creator Vault perks cannot be transferred and end if a Founder's business changes hands, as the Founder Vault terms explain.

17. Selling your business

You may sell or transfer your creator business only with our written approval, which is given when the buyer opens their own account, accepts these terms and passes the same review as any new creator, and where you tell us in writing at legal@plenishly.com before the transfer. Earnings up to the transfer date go to you and later earnings go to the buyer.

18. Disputes

Section 17 (arbitration and class action waiver), Section 18 (governing law and courts) and Section 19 (general) of the Terms of Service apply to these Creator Terms and to anything between you and Plenishly. You can opt out of arbitration within 30 days of first accepting them, by the method in the Terms of Service. Because creators are businesses, the limit of liability in Section 14 of the Terms of Service also applies, and our total liability to you for any claim is limited to the fees you paid us in the 12 months before the claim, or $100 if greater.
